On January 9, 2020, detectives conducted a follow-up investigation into the incident at Harns Marsh Middle School from December of 2019.
Throughout the investigation, detectives interviewed several students who revealed that on December 20, 2019, Anthony exhibited the firearm on the school bus while en route to school, in the cafeteria and while in class. Anthony then threatened his classmates into not reporting his actions to school staff.
On January 9, 2020, detectives found probable cause to arrest Anthony for (1) Count of Improper exhibition of dangerous weapons or firearm on school grounds as defined in Florida State Statute 790.115 (1) and (1) Count of dangerous exhibition of a firearm as defined in Florida State Statute 790.10. Anthony was transported to the Juvenile Assessment Center without incident.
“The safety of the children attending our schools is my absolute, number one priority,” stated Lee County Sheriff Carmine Marceno.
“The amazing relationship that we share with Dr. Adkins and the Lee County School District, along with the incredible work of our Youth Services Division, ensures that our schools are as safe as can be. Dr. Adkins and I have zero tolerance for weapons in our schools.”

Other students alerted school administrators that Hernandez was in possession of a firearm. Hernandez was quickly located, removed from the classroom, and administratively searched. The search revealed and confirmed that Hernandez had a loaded firearm in his backpack.
Detectives with the Lee County Sheriff’s Office Youth Services Division assumed the investigation. After interviewing numerous students and gathering facts, Hernandez was arrested and charged with a felony of Possession of Firearm on School Property.
“I’m very proud of how my team worked quickly with school officials to control this potentially dangerous situation,” stated Sheriff Carmine Marceno. “See it, say it, make the call. That’s what happened here, and it worked.”
